Liability for the content of the operator obligations

The operator obligations listed in this portal represent a limited selection of typical

selection of typical obligations for the operators of technical building facilities,

systems and equipment in facility management. It should be noted that for

technical variants may exist for certain building facilities, systems and operating

which may result in different obligations. Furthermore

legal requirements of federal states and local authorities or conditions imposed by

authorities can also lead to different obligations.

The selection of operator obligations in the myFM portal is not exhaustive and does not cover all technical variants. Additional regulations for certain building facilities, systems and equipment are presented in separate operator obligations of the federal states.

In order to determine the specific operator obligations, it is advisable to have an on-site assessment carried out by a MAQSIMA expert. If there is any doubt as to whether an operator obligation is applicable to the specific building facility, system or equipment, we are happy to offer support.

 

MAQSIMA GmbH reserves the right to adapt, extend or delete existing operator obligations at any time. The operator obligations are adapted to the current state of the art twice a year (in the first and third quarter). There is no entitlement on the part of the user to an individual adjustment of the operator obligations.

 

The cycles for recurring measures specified in the operator obligations have been defined based on experience where no applicable cycles have been specified by the regulator. These cycles serve as maximum deadlines.

In principle, it is the responsibility of each operator to check and determine the applicability, scope, inspection depth and inspection cycles on a company-specific basis. The risk assessment in accordance with the Occupational Health and Safety Act (ArbSchG) is the appropriate instrument for this.

The operator obligations only include measures for the safe operation of systems. The operator obligations do not include requirements relating to quality.
